Article 61 GDPR - Mutual assistance
Frequently Asked Questions
Short answers to common questions about this provision. They are general information and not legal advice.
Paragraph 1 obliges supervisory authorities to provide each other with relevant information and mutual assistance in order to implement and apply the Regulation consistently, and to put in place measures for effective cooperation. Assistance covers in particular information requests and supervisory measures such as prior authorisations and consultations, inspections and investigations.
Paragraph 2 requires the requested authority to take all appropriate measures to reply without undue delay and no later than one month after receiving the request. Under paragraph 5 it must inform the requesting authority of the results or the progress of the measures taken.
Only on the two grounds in paragraph 4, namely that the requested authority is not competent for the subject matter or the measures requested, or that compliance would infringe the Regulation or Union or Member State law to which it is subject. Any refusal must be reasoned under paragraph 5, and paragraph 3 confines the use of exchanged information to the purpose for which it was requested.
If the information referred to in paragraph 5 is not provided within one month of the request, paragraph 8 allows the requesting authority to adopt a provisional measure on the territory of its own Member State in accordance with Article 55(1). In that case the urgent need to act under Article 66(1) is presumed to be met and an urgent binding decision of the Board is required under Article 66(2).
No. Paragraph 7 prohibits charging a fee for any action taken pursuant to a request for mutual assistance. Authorities may nonetheless agree on rules to indemnify each other for specific expenditure arising in exceptional circumstances.
